Scripcorp LLC (the “Company”), and the “BetterWorldRx®” mobile application(s),  corresponding website(s), content, products, and services (collectively, and as further defined herein, the “Services”), along with any Internet domain variations directed to the application or website (the “Site”), hereby disclose the following Privacy Policy statement (the “Policy”), which applies to the Services only, in terms of data collection and usage, to inform users of the Company’s policy regarding the collection, storage, retention, distribution, and/or use of information, including, but not limited to, highly sensitive personal information obtained through the Services and/or the Site.  By visiting and/or using the Services for any purpose, you give your consent to the information collection and distribution practices described herein below.

All material information contained herein or transmitted to or from same, is provided as a courtesy to all users of the Services, including visitors, customers, affiliates, and/or subscribers, whether their visit is intentional or unintentional. As the sole owner of the Services, the Company shall not be liable to any other person or entity for any damages of any kind for any reason pursuant to any legal theory, incurred by the user as a result of its/her/his use the Services or reliance on the content or information contained herein or products obtained hereby. The Company makes no warranty that the content of or information associated with the Services is either reliable or useful for any purpose.  While use of the Service provides to users access to a health-related product or products and information, the Company does not collect personal information implicating or in violation of Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) laws. Every effort has been made by the Company to ensure the privacy of personal information, if any, transmitted to or from the Services pursuant to HIPAA laws and standards. The Company takes reasonable precautions and safeguards to protect the privacy of any personal information, if any, during transmission; however, the Company is not responsible or liable for the privacy of this information, or any loss thereof, during transmission.

PLEASE BE AWARE that, unless otherwise noted, the functionality of, access to, and transmission of personal information, if any, with respect to the Services may not provide or constitute a completely secure and confidential means of communication. It is possible that your use of the Services may be unauthorizedly accessed or viewed by another Internet user while in transit thereto or therefrom. If you intend to keep your personal information completely private, you should not use the Services in connection with any publicly accessible, wired, or wireless Internet service. We may, from time to time, publish communications related to general health benefits, application updates, website updates, health information, and other offers from third-party persons or entities with which the Company may or may not have an affiliation or knowledge of any third party’s policies or practices. Except for such immediate communications, content, information, and/or products or access thereto received as part of your initial use of the Services, in any and every capacity, the Company will take all reasonable steps to ensure that you will have the opportunity to opt-out of future communication from the Company or any third party with whom the Company may share, sell, and/or disclose information, and the Company will make reasonable best efforts to ensure that you will be provided with “opt-out” instructions associated with any such communication.

Collection and Use of Information

Except as may be required as part of your voluntary use of such prescription savings as may be offered through the Services from time to time, the Company will not request that you provide your personal information, such as your name, physical or mailing address, or email address; however, certain information about the hardware and software of the computer and/or mobile device used to access the Services may be collected and used as described below herein.

Collected information about your hardware and software collected by the Company may include, by way of example and not limitation: your device Operating System (“OS”), your internet protocol (“IP”) address, device type, domain names, access times, download requests, and referring website addresses. This information is used by the Company to help provide the Services to its users, customers, and visitors and to collect general statistics regarding the use of the Services. The Company collects and uses this personal information to deliver products and services requested through any interaction with the Services. The Company may also use your personal information to inform you of other products or services offered by the Company and/or its affiliates and third-party merchants. The Company may also use this information from time to time to send you communications and advertisements or to conduct market research regarding current services or potential new services. IMPORTANT: The Company reserves the right to also sell, lease, and/or share the collected with third parties, whether or not for commercial purposes or profit.  By providing the Company with such personal information as part of your use and/or interaction with the Services, you consent to allow the Company to use the information for any worthwhile purpose, at the Company’s sole election, without limitation and in perpetuity, unless prohibited by law.

The Company will disclose all necessary collected information, of any nature, without limitation and without notice, if required to do so by law or in the good faith belief that such disclosure is necessary to: (a) conform to the edicts of the law or comply with legal process served on the Company or the Site; (b) protect and defend the rights or property of the Company; and (c) act under exigent circumstances to protect the personal safety of users of the Services or the products/services of the Company or the public. The Company is not responsible for any privacy policies, statements, or other third-party content outside of the Services.

While actual use of any information collected may be generally be limited to the purpose of transmitting prescription discount information related to provision of the Services, all users of the Services must assume that it will be used extensively and for other purposes, in the Company’s sole discretion. You must assume that any information collected is shared with other persons or entities for commercial purposes. This Policy is being disclosed for the purpose of helping you to decide whether or not to access, view, or, in any way, interact with the Services. This type of collected and/or shared information may include, if legally collected, your name, physical and/or mailing address, email address, IP address, and buying habits, as well as other personal information collected directly or indirectly. This collected and/or shared information may be used for general commercial solicitation by the Services or by other persons or entities to whom such information may be sold, leased, and/or shared.

Electronic Methods of Data Collection (“Cookies”)

The term “cookies” refers to bits of computer code placed on your computer and/or mobile device or on your computer hard drive.  The Company may use cookies for a variety of reasons such as, by way of example and without limitation: (a) to keep a visitor “logged in,” (b) to keep track of search criteria, to log and remember charitable selection(s), to monitor use, to password-protect use of the Services or use of products delivered or sold by the Services. Cookies can also be used to obtain information about the configuration or use of your computer and/or mobile device.

Cookies may be used to electronically gather information about you. Regardless of whether such information is personal in nature, by using the Services, you consent to allow the Company to use cookies and to use any and all information gathered or collected, as the Company may see fit and in the Company’s sole discretion. Furthermore, by using the Services, you further consent to allow the Company to collect, archive, retrieve, and use any information collected for any lawful purpose whatsoever, including, but not limited to, product design, product offers to you, and general commercial solicitation purposes through the Services, by the Company or by any third-party persons or entities with whom any or all or your information collected may be sold, leased, and/or shared at the sole election of the Company and without your further permission beyond this Policy and related Terms of Use and License Agreement posted in, on, or in conjunction with any offering of the Services.

Bulletin Boards and Public Forums

Any visitor to an application or website that provides bulletin boards or other public forums, including, but not limited to, chat rooms, blogs, feedback channels, social media, and/or other websites, does so at their own risk.  You must not assume that the Company or the Services monitor these third-party products or services, assumes any liability for, or otherwise protects you in any manner whatsoever from or with regard to information you post publicly or share with anyone else via the Services.


It is the intent of the Policy to comply with the OPPA. Various provisions throughout this Policy address requirements of the OPPA. In summary, users of the Services must presume and accept that personal information, including, but not limited to, that listed, described, or referenced anywhere in this Policy, will be collected, retained, and distributed. To, at least some degree, said collected information will be personally identifiable. If you utilize the Services to voluntarily obtain a product or service involving a financial transaction and thereby become covered by the OPPA, the purchase agreement you electronically sign prior to purchase allows the Services to collect and archive all the personal information you provide and to transmit and/or transfer that personal information to third parties. You have no right or ability to modify this information. Under the terms of any purchase agreement and/or the Terms of Use and License Agreement posted herewith, and incorporated by reference herein, you have no right to view or receive any information, in whole or in part, collected or retained by the Company. In the event that the Services, under advice of counsel, agrees to disclose any collected information, the party requesting such disclosure shall be required to submit such information as may be deemed necessary by the Company in order to ensure disclosure of such information in accordance with Company policies and applicable laws. Other provisions of the OPPA may exempt the Company from complying with any such request, and any decision to disclose information collected, in whole or in part, is done so at the Company’s sole election, in accord with applicable laws. While the Company takes reasonable measures to ensure the privacy of its transmissions of information to authorized third parties, the Company does not warrant that outside parties will not or cannot gain unauthorized access to your information. As a standard practice, merchant service providers do not allow the Company access to any financial transaction information such as a credit card, debit card, or alternate method of payment.

System Security

The Company has taken reasonable steps and has employed industry-standard practices and technology to ensure the integrity and confidentiality of personally identifiable information while in transmission, but. because even the most secure mobile device and/or computer system may be violated, the Company can, in no wise, guarantee the security of the relevant systems, information, or transmission processes.

Health Information Policies

In the event any medical and/or personal health information is inadvertently transmitted to the Company as part of your visit to or use of the Services, this notice describes how such medical and/or personal health information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Privacy Promise

The Company understands that your medical and individual health information is personal. Protecting such information is important to the Company. We adhere to all applicable federal and state laws regarding the confidentiality of any medical and/or personal health information obtained whether intentionally or unintentionally.

The Company reserves the right to make changes to thnotice Policy at any time and without notice and to make any such changes to the Policy and applicable privacy practices effective for all collected information we maintain. The Company will make good faith best efforts to post timely Policy updates and notices on the Services.

Sharing Personal Health Information

There are limited situations when the Company may be permitted or required to disclose personal health information without your personal signed authorization.

These situations include, by way of example and without limitation:

    •  For public health purposes such as reporting communicable diseases, work-related illnesses, or other diseases and injuries permitted by law; reporting births and deaths; and reporting reactions to drugs and problems with medical devices;

    •  To protect victims of abuse, neglect, or domestic violence;

    •  For health oversight activities such as investigations, audits, and inspections;

    •  For lawsuits and similar proceedings;


    •  When requested by law enforcement as required by law or court order;

    •  To coroners, medical examiners, and funeral directors;

    •  To reduce or prevent a serious threat to public health and safety;

    •  For workers’ compensation or other similar programs if someone is injured at work;

    •  For specialized government functions such as intelligence and national security; and

  • When otherwise required by law;

Other uses and disclosures may, as required by law, necessitate a personal signed authorization. Anyone authorizing the use of personal health information may revoke said authorization at any time with a written statement; however, the Company or any provider of third-party products and/or services may not be able to reverse the use or withdraw the disclosure of personal health information while a lawful authorization was/is in effect.

Your Individual Rights

You have the right to:

    • Request restrictions on how we use and share your individual medical and/or personal health information. The Company will consider all requests for restrictions but are not required to agree to any restriction;

    • Request that the Company use a specific telephone number or address to communicate with you;

    • Request to inspect and copy your collected individual medical and/or personal health information, if any. Fees may apply as allowed by law. Under limited circumstances, the Company may deny you access to any or all of your collected individual medical and/or personal health information, and you may request a review of the denial;

    • Request corrections or additions to your collected individual medical and/or personal health information.; and

    • Request a paper copy of this notice even if you agree to receive it electronically.

    • All requests described above must be made in a writing executed by the person to whom the collected medical and/or personal health information pertains. Contact the Company for the appropriate form for your request.

This Policy describes the privacy practices of the Company and certain associates / affiliates with whom the Company does or may do business but does NOT NECESSARILY include the privacy practices and policies of its suppliers, customers, and other healthcare entities, each of whom should be contacted directly for their respective individual practices and privacy policy statements.
